REMINDER: NYS Licensing Applications Deadline Extended Through December 18
The submission deadline is December 18, 2023. As we noted in our previous newsletters, there are five types of licenses:
- Adult-Use Cultivator
- Adult-Use Processor
- Adult-Use Distributor
- Adult-Use Retail Dispensary
- Microbusiness
New Dispensary on Long Island
Congratulations to Little Beach Harvest Dispensary that opened its doors in South Hampton, NY. The Little Beach Harvest Dispensary is owned and operated by the Shinnecock Indian Nation which is a federally recognized tribe living on their traditional lands in Long Island. This opening is a culmination of many years of effort by the Shinnecock Nation. The dispensary will offer adult-use and medical cannabis products to its customers as well as education and community involvement.
Governor Hochul Signs Additional Cannabis Tax Relief
Governor Hochul signed legislation, Senate Bill S7508 last week that allows New York City cannabis business owners and operators to deduct certain business expenses giving NYC cannabis businesses tax relief from the restrictive 280E Tax Code regulation. The newly signed legislation amended the NYC administrative tax code and now permits certain tax deductions related to the sale, production, or distribution of cannabis products.
NYS Regulators and Licensing Lawsuit
Some hopeful news. Several news outlets reported last week that the lawsuit from a group of disabled military veterans against NYS cannabis regulators, i.e., Office of Cannabis Management and the Cannabis Control Board, may be nearing some sort of an agreement that is awaiting finalization and approval by the courts. Once it is approved, it could lift the temporary injunction and allow hundreds of Cannabis Adult Retail Dispensaries (CAURD) licensees to open their doors.
New Jersey News
REMINDER: NJ Cannabis Regulatory Commission (NJCRC) Comment Period Open Through December 15
A Public Comment period opened on October 16, 2023. The NJCRC is seeking feedback and commentary on their proposed regulations regarding the expansion of cannabis edibles in the New Jersey cannabis market. The comment period ends on December 15, 2023.
You can submit your comments in writing to the NJCRC or attend their next public meeting.

REMINDER: MCA Submissions Open Through December 12.
The Maryland Cannabis Administration (MCA) opened the application process for cannabis business licenses on November 13, 2023 and will close the submission period on December 12, 2023.

- 32 Standard Processors – distributed by Region
- 24 Micro Growers – distributed by Region

Update on Adult-Use Ballot Measure
On November 8, 2023, the Florida Supreme Court heard arguments regarding an Adult Use Ballot Measure. The oral arguments were heard from both sides, with each getting 20 minutes to present their cases regarding whether or not to add a ballot measure to the General Election on November 5, 2024.
As we asserted in our October Newsletter, the state’s Governor, Ron DeSantis, does not support the measure and neither does the Attorney General, Ashley Moody.
The Florida Supreme Court has until April 1, 2024 to decide on the case. The session where the arguments were heard “for” and “against” the Adult-Use Ballot Measure measure can be viewed on this YouTube video link. It really is a very interesting watch.

Ohio Approves Adult-Use
The results are in: Ohioans said “yesian” and voted to legalize Adult-Use Marijuana!
Ohio became the 24th state to legalize and regulate possession, home cultivation, retail sale of cannabis for those 21 years and older. Ohio is expected to bring in hundreds of millions of dollars in tax revenue if they do vote to legalize, according to an economic impact study done by Ohio State University.
Looming on the heels of Ohio voters making their decision at the ballot box, Governor Mike DeWine wants to tweak the laws.

Japan News
Japan Allows Cannabis Derived Medical Products
Japan’s Lower House passed a bill last week that allows medical products derived from cannabis, while reinforcing other marijuana products that are banned. The bill also seeks to revise other laws related to cannabis. A known product, Epidiolex, approved for use in the United States and in Europe to treat epilepsy, is under a clinical trial in Japan. This bill may pave the way for its approved use in Japan.

Portugal – Major Cannabis Exporter To Europe
Portugal is breaking records regarding how much medical cannabis it exports to other European countries. This year, it is expected to surpass the 2022 levels of exports which reached 9,271 kg. Portugal’s international medical cannabis trade has many benefits that positively impact its economy.
